The Kerala High Court closed a criminal miscellaneous case after the petitioner’s counsel submitted that the matter had become infructuous. The Court, taking note of the submission, recorded it and disposed of the petition accordingly.
- The petitioner, Raveendran, aged 60 years, was arrayed as an accused in Crime No. 151/2019 registered at Karipur Police Station, Malappuram.
- He approached the High Court by filing Crl.M.C. No. 4279/2020 challenging the order dated 09.09.2020 passed in Crl.M.P. No. 1054/2020 by the Chief Judicial Magistrate, Manjeri.
- During the course of hearing, the petitioner’s counsel informed the Court that the relief sought had become unnecessary due to subsequent developments, rendering the matter infructuous.
- Justice G. Girish noted the submission made by the learned counsel for the petitioner that the matter no longer required consideration.
- Accordingly, the Court recorded the submission and ordered that the Crl.M.C. be closed as infructuous.
- Section 482, Code of Criminal Procedure, 1973 – Inherent powers of the High Court to make orders to prevent abuse of process of court or to secure the ends of justice.
