The Kerala High Court dismissed a criminal miscellaneous case as not pressed after the petitioner’s counsel submitted that further proceedings were unnecessary. The Court, accordingly, recorded the submission and dismissed the petition.
- The petitioner, Anoop Mathew, aged 21 years, was an accused in Crime No. 636/2017 registered at Perumpetty Police Station, Pathanamthitta, and corresponding S.C. No. 276/2018 before the Special Court under the POCSO Act, Pathanamthitta.
- He approached the High Court under Section 482 of the Code of Criminal Procedure, 1973, by filing Crl.M.C. No. 8939/2019, seeking relief related to the said proceedings.
- During the hearing, the petitioner’s counsel submitted that the petition need not be pursued further as the matter had become infructuous.
- Justice G. Girish noted the submission of the petitioner’s counsel that continuation of the proceedings was unnecessary.
- Accordingly, the Court dismissed the Crl.M.C. as not pressed.
