The Kerala High Court allowed a writ petition directing the Village Officer to issue a possession certificate to the petitioner for availing an educational loan, while recording any pending revenue recovery proceedings as mandated under Clause 220 of the Kerala Land Revenue Manual. The Court held that such a stipulation does not prohibit issuance of the certificate and refusal to issue on this ground alone was not legally valid.
- The petitioner sought a possession certificate for his property from the 1st respondent (Village Officer) to secure a loan for his daughter’s education abroad.
- The 1st respondent refused to issue the certificate citing pending revenue recovery proceedings against the property.
- The petitioner’s counsel emphasized urgency due to the daughter’s admission in Melbourne.
- The Senior Government Pleader submitted that the certificate can be issued, but must mention any pending revenue recovery proceedings, in compliance with Clause 220 of the Kerala Land Revenue Manual (KLRM).
- Clause 220(1) of the KLRM allows issuance of possession certificates to establish ownership, with verification of documents and registration of any pending recovery proceedings.
- The Court found that the stipulation to indicate pending revenue recovery proceedings does not bar issuance of the certificate.
- No statutory provision prevents issuance of possession certificates in such cases, and the refusal by the Village Officer was not sustainable in law.
- Given the petitioner’s urgent need, the Court directed issuance of the certificate by 11 November 2025, with a record of any pending revenue recovery proceedings.
