Headnote:
The Kerala High Court quashed all further proceedings against the petitioners under Sections 498A and 406 read with 34 IPC in Crime No. 237/2019 of Edavanna Police Station, Malappuram, arising from CC No. 173/2022 on the file of the Judicial First Class Magistrate Court-II, Manjeri. The Court held that since the dispute between the accused and the defacto complainant had been amicably settled, and the victim had no grievance or interest in continuing prosecution, continuing the proceedings would amount to abuse of court process. The inherent powers of the High Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, were invoked to quash the proceedings.
