The Kerala High Court dismissed as withdrawn a criminal miscellaneous petition filed under Section 482 of the Code of Criminal Procedure, 1973 (CrPC), after the petitioner’s counsel submitted that the final report in the same case had already been challenged through another proceeding.
- The petitioner, Suraj S. Das @ Sooraj Dasan, aged 43 years, resident of Valakkadavu, Njarakkal, Ernakulam, was the accused in Crime No. 134/2019 registered at Narakkal Police Station.
- The present petition (Crl.M.C. No. 7890/2019) was filed seeking relief in connection with the said crime.
- During admission, counsel for the petitioner submitted that the final report in the case was already under challenge in another proceeding, and hence sought permission to withdraw the petition.
- The Court recorded the submission of the petitioner’s counsel and observed that, in light of the parallel challenge already filed, there was no necessity to proceed further with this petition.
- Accordingly, the Criminal Miscellaneous Case was dismissed as withdrawn.
- Section 482, Code of Criminal Procedure, 1973 (CrPC) – Inherent powers of the High Court to prevent abuse of process of law and to secure the ends of justice.
