The Kerala High Court dismissed two connected criminal miscellaneous cases as withdrawn upon the petitioner’s request. The Court granted permission for withdrawal and accordingly closed both petitions.
- The petitioner, Pranjith, aged 38 years, had filed Crl.M.C. Nos. 3472/2020 and 4062/2020 before the High Court challenging orders in CMP Nos. 712/2020 and 741/2020 of the Judicial First Class Magistrate Court–I, Punalur.
- The cases arose from Crime No. 156/2020 registered at Kulathupuzha Police Station, Kollam.
- The dispute stemmed from a contractual disagreement between the petitioner and the third respondent, Muraleedharan Pillai, following an agreement dated 5 August 2019.
- The petitioner had also instituted a civil suit, O.S. No. 96/2020, before the Munsiff Court, Nedumangad.
- During the hearing, the petitioner’s counsel sought permission to withdraw both criminal miscellaneous cases.
- The Court granted permission for withdrawal and dismissed both Crl.M.C. Nos. 3472/2020 and 4062/2020 as withdrawn.
- Section 482, Code of Criminal Procedure, 1973 – Inherent powers of the High Court to prevent abuse of process or to secure the ends of justice.
