Headnote:
The Kerala High Court in Crl.M.C. No. 4840 of 2025 quashed proceedings against the third respondent, Kurikkal Parambil Nasar, arising out of Crime No. 147/2017 of Perumpadappu Police Station. The petitioner, Sheeba, the de facto complainant, submitted that the dispute, which involved allegations under Sections 406 and 498A read with Section 34 IPC, had been amicably settled with the accused. Considering the private nature of the dispute and to prevent abuse of the judicial process while maintaining harmonious relations between parties, the Court allowed the petition and terminated the criminal proceedings against the accused.
Background:
Sheeba, aged 47, filed a criminal miscellaneous petition seeking quashment of proceedings against the third respondent in L.P. No. 54 of 2024 pending before the Judicial First Class Magistrate Court-I, Ponnani. The criminal case pertained to allegations of criminal breach of trust and cruelty (Sections 406 and 498A IPC) involving the accused. The petitioner filed an affidavit confirming that the dispute with the accused had been amicably settled and that she no longer wished to continue the prosecution. The Public Prosecutor confirmed that the petitioner had also informed the Investigating Officer of the settlement.

Justice G. Girish held that since the matter was private and had been amicably resolved between the parties, continuation of prosecution would serve no purpose and could amount to an abuse of court process.
