Kerala High Court Upholds Life Sentences of Six Convicted Assailants in Munambam Abhilash Murder Case After Thorough Evidence Review
The Kerala High Court confirmed life imprisonment for six individuals convicted in the Munambam Abhilash murder case, dismissing their appeals as devoid of merit. Abhilash, a CPI(M) activist, was attacked and killed on May 19, 2005, by the appellants, alleged BJP workers, using swords and iron rods. The Court meticulously reviewed oral and documentary evidence, finding the prosecution successfully established guilt beyond reasonable doubt. Minor contradictions in witness statements were deemed natural due to the 13-year gap since the incident and cross-examination, but these did not undermine the prosecution’s narrative. Contentions regarding non-identification of vehicles involved and the absence of assailants’ names in wound certificates were rejected, as evidence of seizure and hospital records corroborated the events. The appellants were convicted under Sections 143, 147, 148, 341, 302 read with 149 IPC and Section 27 of the Arms Act. The Court emphasized that procedural or minor factual lapses do not invalidate well-substantiated prosecution claims. By confirming the lower court’s verdict, the High Court reinforced accountability for violent crimes, underscoring the principle that evidence-based convictions withstand appeals even years after the offense. This judgment serves as a precedent for handling politically motivated violent crimes and evaluating long-delayed evidence.
