Madhya Pradesh High Court Suspends Life Sentence in Murder Conviction; Orders Planting of Ten Saplings as Condition for Bail
A Division Bench of Madhya Pradesh High Court—Justices Anand Pathak and Pushpendra Yadav—granted suspension of a life sentence to Mahesh Sharma, convicted in a murder case under IPC Sections 302 and 149, noting that he had spent approximately 10 years and 8 months in pre-trial and post-trial custody. His co-accused, in similarly situated circumstances, had already been granted bail. The court conditioned the suspension: bail bond of ₹50,000 with two sureties of like amount; appearance before the High Court Registrar on a specified date; and deposit of fine. Unique to this case, the court directed Mahesh Sharma to plant and nurture 10 fruit-bearing or Neem/Peepal saplings, monitor their growth, and submit geo-tagged photos via the High Court’s “NISARG App” periodically until final disposal of appeal. The direction is intended as a symbolic “test case” to promote environmental stewardship, harmony with nature, kindness, and the notion of social reformation. Bail will be revoked if the appellant causes harassment or embarrassment to the complainant.
