Madras HC Validates Reassessment Notices Issued Pre-Finance Act, 2021 Citing TOLA Extension
The Madras High Court has upheld the validity of income tax reassessment notices that were issued before the enactment of the Finance Act, 2021, citing the applicability of the Taxation and Other Laws (Relaxation and Amendment of Certain Provisions) Act, or TOLA. TOLA was introduced to extend various time limits during the COVID-19 pandemic. The petitioners had challenged the notices, arguing that they were issued under the old reassessment regime, which was replaced by a new one in the Finance Act, 2021. However, the High Court held that the TOLA extension was valid and that the notices issued during this extended period under the old law were legally sustainable. This judgment provides a significant victory for the revenue department, as it validates a large number of reassessment proceedings that were initiated during the pandemic-affected period, preventing them from being quashed on technical grounds.
