Madras High Court Directs State to Compensate Damage During Political Party Meetings
The Madras High Court, in a petition filed by the political party Tamilaga Vettri Kazhagam (TVK), directed the Tamil Nadu State to implement measures to compensate individuals affected by damages occurring during political party public meetings. Justice N. Sathish Kumar noted that, typically, public meetings result in damage to property, and victims often remain uncompensated. To address this, the Court impleaded the Chief Secretary and Home Secretary, instructing the State to establish rules requiring political parties to deposit a fixed amount while seeking permission for public meetings. This fund would be used to pay compensation for any resulting damages. The Court emphasized that legislative provisions are not strictly necessary; the State’s will to create a policy suffices. It further criticized improper affidavits filed by subordinate police officers instead of senior authorities, highlighting the need for accountability. Additionally, the Court imposed a requirement that political parties wishing to join the case must deposit Rs. 5 lakh as proof of their credentials, preventing frivolous participation for publicity.
