MahaRERA – Dispute Arising Out Of Development Agreement Is Not Maintainable
The Maharashtra Real Estate Regulatory Authority (Authority), led by Mahesh Pathak (Member), ruled that disputes arising from a development agreement do not fall within its jurisdiction under the Real Estate (Regulation and Development) Act, 2016. \r
The case involved a complaint by a Housing society regarding unauthorized construction and lack of approvals by the builder, stemming from a development agreement signed with M/s J.P Builders & Developers. The Authority emphasized that such disputes are of a civil nature and should be addressed in a Civil court. \r
Additionally, it noted that allegations regarding construction permissions and registration without proper approvals should be handled by the Municipal Corporation, not MahaRERA. Consequently, the Authority dismissed the Housing society's complaint for lack of jurisdiction.
