The Madras High Court has ruled that a wife making unsubstantiated and reckless allegations of sexual assault against her husband and father-in-law constitutes extreme mental cruelty, providing a valid ground for the husband to seek a divorce. The court observed that such serious and defamatory allegations, when found to be false, can cause irreparable damage to an individual's reputation and mental peace. It held that the act of filing a false police complaint of such a grave nature goes beyond the normal wear and tear of marital life and amounts to cruelty. The judgment differentiates between genuine complaints and malicious allegations used as a tool in matrimonial disputes. By granting a divorce on this basis, the court has sent a strong message that while the law must protect victims of sexual assault, the legal process cannot be misused to harass and inflict mental torture on family members.
