MP High Court Refuses To Quash Forgery FIR Against Government Officer Following Journalist’s Complaint
The Madhya Pradesh High Court (MPHC) dismissed an application by a government officer seeking the quashing of an FIR for alleged forgery of complaints lodged in his name and that of his driver, following a complaint by a journalist. The court held that the allegations on the face of the FIR disclosed prima facie cognizable offences, the investigation was conducted in accordance with law and no mala fide or ulterior motive was substantiated. The journalist’s complaint alleged forged speed-post articles made under his name to the Transport Minister and Commissioner. The turn down reinforces that procedural stages of inquiries cannot be short-circuited where material suggests a wrongdoing warranting investigation.
