MP High Court Seeks Explanation for Non-Registration of FIR Over Infant Deaths in Government Hospital
The Madhya Pradesh High Court took suo motu cognizance of the deaths of two infants at M.Y. Hospital, Indore, allegedly due to rat bites in the ICU. A Division Bench comprising Justices Vivek Rusia and Jai Kumar Pillai directed the Police Commissioner of Indore to explain why no FIR had been registered. The Court observed prima facie gross negligence on the part of hospital administration and noted that no action had been taken against officers, doctors, or staff. One of the deceased infants belonged to a tribal family from Dhar district, emphasizing the need for accountability. During hearings, officials contended that deaths were due to congenital malformations and cited infrastructural shortcomings, pest control lapses, and staff shortages. The Court directed the Public Works Department to submit a detailed report on hospital building conditions, drainage, electrification, and budgetary requirements for renovation. Additionally, a DPR was to be prepared for repairs. The Court also issued notices to various officials, including the Director of Health, hospital authorities, and the contractor for pest control services. The matter was listed for further hearing, highlighting judicial oversight in ensuring state accountability and safety in public health institutions.
