NCLAT Dismisses Appeal by Former Promoter: Upholds Insolvency Admission by NCLT
The National Company Law Appellate Tribunal (NCLAT) has dismissed an appeal filed by a former promoter of a company, thereby upholding the NCLT's decision to admit the company into the insolvency process. The promoter had challenged the admission of the insolvency plea, which was likely filed by a creditor due to a default in payment. However, the NCLAT, after reviewing the arguments and the evidence on record, found no reason to interfere with the NCLT's order. The appellate tribunal was satisfied that there was a clear existence of debt and a default, which are the primary requirements for initiating the Corporate Insolvency Resolution Process (CIRP). The dismissal of the appeal confirms that the company will remain in insolvency, and the resolution professional will continue with the process of finding a revival plan for the company.
