NCLAT Dismisses Appeal by Suspended Company Director: Upholds Insolvency Against the Company
The National Company Law Appellate Tribunal (NCLAT) has dismissed an appeal filed by the suspended director of a company, thereby upholding the order to initiate insolvency proceedings against the company. The director had challenged the admission of the insolvency plea by the National Company Law Tribunal (NCLT). However, the NCLAT, after reviewing the case, found no legal infirmity in the NCLT's order. The appellate tribunal was satisfied that there was a clear case of debt and default by the company, which are the necessary conditions for admitting an insolvency application filed by a creditor. By dismissing the appeal, the NCLAT has allowed the Corporate Insolvency Resolution Process (CIRP) to continue, paving the way for the resolution professional to take over the company and work towards a resolution plan for the benefit of all creditors.
