NCLAT Dismisses Proceedings Initiated u/s 9 of I & B Code against Kerala Medical Services Corporation based upon a material concealment of fact
The National Company Law Appellate Tribunal (NCLAT) has dismissed insolvency proceedings that were initiated against the Kerala Medical Services Corporation Ltd (KMSCL), a state government undertaking. The proceedings, filed by an operational creditor under Section 9 of the I&B Code, were dismissed on the grounds of a "material concealment of fact" by the creditor. The NCLAT found that the operational creditor had not disclosed certain crucial facts about the dispute to the NCLT. The tribunal held that it is the duty of the applicant to approach the tribunal with clean hands and to disclose all relevant information. The concealment of a material fact was deemed to be a sufficient ground to dismiss the insolvency application. This ruling protects the government corporation from insolvency proceedings that were initiated on a false or incomplete premise.
