NCLAT permits RP to Issue Fresh Form G and to Invite Eol from New Eligible Resolution Applicants by strictly Adhering to Time Bound CIRP Process
The National Company Law Appellate Tribunal (NCLAT) has permitted a Resolution Professional (RP) to issue a fresh Form G and to invite a new round of Expressions of Interest (EoI) from eligible resolution applicants. This decision was taken to ensure that the Corporate Insolvency Resolution Process (CIRP) remains competitive and that the best possible resolution plan is found for the distressed company. However, the NCLAT has also emphasized that this must be done by strictly adhering to the time-bound nature of the CIRP. The tribunal's order allows the RP to broaden the pool of potential bidders for the company, which can lead to a better value maximization for the creditors. At the same time, the direction to adhere to the timeline ensures that the process does not get delayed indefinitely.
