NCLAT Rejects Suspended Director’s Challenge to CIRP, Asserts Timely Resolution over Procedural Technicalities
The NCLAT (National Company Law Appellate Tribunal) has rejected a suspended director's challenge to the Corporate Insolvency Resolution Process (CIRP), asserting "timely resolution over procedural technicalities." The tribunal emphasized that the primary objective of the Insolvency and Bankruptcy Code (IBC) is the expeditious resolution of insolvency. While procedural adherence is important, the NCLAT will not allow technicalities to derail a CIRP that is otherwise progressing towards a resolution, prioritizing the larger goal of value maximization for creditors and revival of the corporate debtor.
