NCLAT Upholds Insolvency Against Jaypee Cement, Dismisses Appeal by Suspended Director
The National Company Law Appellate Tribunal (NCLAT) has upheld the insolvency proceedings initiated against Jaypee Cement Corporation Ltd. The appellate tribunal dismissed an appeal filed by a suspended director of the company who had challenged the admission of the insolvency plea by the NCLT. The NCLAT, after reviewing the records, found no merit in the director's appeal and affirmed the NCLT's decision. The ruling confirms that the company had defaulted on its debt obligations, which is the primary condition for initiating the Corporate Insolvency Resolution Process (CIRP) under the Insolvency and Bankruptcy Code.
