NCLT initiates insolvency proceedings against Gensol Engineering and Gensol EV Lease following IREDA Petitions
The National Company Law Tribunal (NCLT) has admitted an insolvency plea against Gensol Engineering Ltd. and has directed the commencement of the Corporate Insolvency Resolution Process (CIRP) for the company. The insolvency application was filed by an operational creditor who claimed that Gensol Engineering had defaulted on its payment obligations. With the admission of the plea, an Interim Resolution Professional (IRP) will be appointed to take over the management of the company. The IRP will be responsible for running the company's operations and inviting claims from all its creditors. This development puts a moratorium on all other legal proceedings against the company. The Committee of Creditors will now be formed to explore possibilities for a resolution plan to revive the company, failing which it may be pushed into liquidation.
