The National Company Law Appellate Tribunal (NCLAT) ruled that the Resolution Professional (RP) of Jet Airways is not liable for employee payments related to preserving and managing the airline's operations during its insolvency process. This decision followed appeals from Jet Airways’ former employees and operational creditors. The Supreme Court upheld this ruling, emphasizing that unpaid labor dues, such as provident fund and gratuity, take precedence. The consortium of new owners must cover these dues, which include approximately ₹247.8 crore in gratuity claims and damages under the Employees’ Provident Funds Act. The court highlighted that any entity taking over should expect such obligations, ensuring fairness to employees amidst financial restructuring
