Pending Statutory Appeal and Stay Petition: Kerala HC stays Income Tax Recovery Proceedings [Read Order]
The Kerala High Court stayed recovery proceedings under the Income Tax Act, 1961 against Jolly Saji until the Income Tax Department decides on the stay petition filed alongside the statutory appeal within two months. Saji, aggrieved by the assessment order for the year 2019-2020, appealed to the Commissioner of Income Tax (Appeals) and concurrently filed a stay petition to halt recovery actions.
Despite this, the department directed Saji to pay 20% of the demanded amount. Justice Murali Purushothaman directed the department to expedite the stay petition's decision within the stipulated period, prohibiting any recovery proceedings until then. Advocates Dinesh. R.
