Principal Place of Business Upgraded with Amended GST Certificate: Himachal Pradesh HC Directs to Grant Renewal of License L-10BB\r\n\r\n
The Himachal Pradesh High Court has ordered the renewal of License L-10BB for a business located at The Mall Road, Manali, District Kullu, following the upgrade of its principal place of business with an amended Goods and Service Tax (GST) certificate. The petitioner, who initially received the license in 2021, had it renewed for subsequent years. \r
However, after a clarification was issued on December 20, 2023, requiring businesses to operate from their principal place of business, the petitioner took steps to comply, including obtaining an amended GST Registration Certificate. Despite this, their request for license renewal was initially rejected. \r
Representing the petitioner, Mr. Vaidya argued that the business had met all necessary formalities and paid the required fees, making the rejection of their renewal request unjustified. Justice Sandeep Sharma agreed, quashing the Financial Commissioner's order of April 16, 2024, and directing the respondents to renew the license. The court emphasized the need for expedited action within ten days to avoid financial losses for both the petitioner and the state.
