In a recent landmark judgment, a three-judge bench of the Supreme Court in Ravikumar Dhansukhlal Maheta v. High Court of Gujarat clarified that while promotion itself is not an absolute right, the right to be considered for promotion is indeed a fundamental right under Article 16 of the Constitution. \r
This verdict reinforces the principle that promotion policies must ensure equal opportunity and be free from discrimination. It underscores that any denial of the right to be considered for promotion to eligible candidates within the zone of consideration would constitute a violation of their fundamental rights. \r
Moreover, the judgment links promotion practices to the broader constitutional guarantees of equality (Article 14) and the right to life with dignity (Article 21), emphasizing the importance of fair and transparent promotion policies in upholding these constitutional principles.
