The Punjab & Haryana High Court directed the State of Punjab to refund the principal amount deposited by police personnel towards the Contributory Fund (New Defined Contribution Pension Scheme) within three months. The Court held that payment of interest would be governed by the outcome of LPA No. 649 of 2023, wherein the issue of entitlement to interest @ 8.1% per annum is pending adjudication.
- The petitioners, serving as members of the Punjab Police Force, approached the Court under Articles 226/227 of the Constitution of India, seeking refund of their contributions to the New Defined Contribution Pension Scheme (NDCPS), along with interest at the rate of 8.1% per annum.
- They relied upon an earlier judgment dated 30.03.2022 in CWP No. 35361 of 2019 – Constable Bikramjit Singh & Ors. v. State of Punjab & Ors., wherein similar relief was granted to other employees.
- The petitioners contended that despite this precedent, their refund claims had not been settled.
- The learned Deputy Advocate General, Punjab, informed the Court that the principal amounts are being refunded to all similarly placed employees.
- However, the demand for interest has been stayed by the Division Bench in LPA No. 649 of 2023, which is pending consideration.
- Taking note of the State’s statement, the Court found it appropriate to issue directions confined to refund of the principal, keeping the interest issue subject to the Division Bench’s final decision.
- The writ petition was disposed of with a direction to the respondents to refund the principal amount to the petitioners within three months from the date of the order.
- The petitioners’ entitlement to interest shall be determined in accordance with the final order passed by the Division Bench in LPA No. 649 of 2023.
- All pending applications were also disposed of.
