PVC Regrind Not Restricted Waste: CESTAT Classifies It as Freely Importable
The Customs, Excise and Service Tax Appellate Tribunal (CESTAT) has ruled that "PVC regrind" is not a restricted waste product and can be freely imported. The customs department had sought to classify PVC regrind, which is a form of recycled plastic, as a hazardous or restricted waste, the import of which is controlled. However, the CESTAT, after examining the nature of the product and the relevant environmental and import policy regulations, concluded that it does not fall under the restricted category. The tribunal held that it is a raw material that can be used by the domestic industry.
