Rajasthan High Court Sets Aside Trial Court's Ad-Interim Order Due To Earlier Contradictory Order In Another Matter Pending Between Same Parties
In Abdul Rahim and Anr. v M/S Khatri Marble Mines Makrana and Ors., the Rajasthan High Court, under Justice Madan Gopal Vyas, quashed a contradictory ad-interim order issued by a trial court. \r
The trial court had initially restrained all mining activities pending boundary demarcation in a mine at Gunawati Range on April 4, 2024, following a suit by the respondent for specific performance of contract and permanent injunction. \r
However, in a prior suit by the appellant, the same court had permitted the appellant to continue mining on March 1, 2024. The High Court deemed the April 4 order invalid due to this contradiction, highlighting the trial court's lack of application of mind, and consequently set it aside.
