The Supreme Court has quashed a rape case filed against a man, ruling that a consensual relationship turning sour or partners separating cannot be grounds for initiating a rape case based on a "false promise of marriage." The Court expressed concern over the tendency to treat every breach of promise to marry as a false promise under Section 376 of the IPC. It observed that the complainant's conduct did not corroborate her allegations of non-consensual intercourse and found no evidence of coercion, concluding that the criminal prosecution was likely with an underlying motive.
