Relief to Bharti Airtel: CESTAT directs Dept to Wait for Outcome of Investigation before Rejecting Rectification Application under Customs Act
The Customs, Excise, and Service Tax Appellate Tribunal (CESTAT) granted relief to Bharti Airtel by directing the Customs Department to await the outcome of an ongoing investigation before rejecting the company's rectification application under the Customs Act. Bharti Airtel had filed for rectification regarding certain errors in its duty payment. The Department, however, moved to reject the application prematurely, without considering the pending investigation that could affect the decision. CESTAT found that the rejection was unjustified and ordered the Department to defer any decision until the investigation's results were available, thus ensuring due process and fairness.
