Responsibility Of Customs Broker Does Not Include Keeping Continuous Surveillance On Client: CESTAT
The Delhi Bench of Customs, Excise, and Service Tax Appellate Tribunal (CESTAT) ruled that the responsibility of customs brokers under Regulation 10(n) of the Customs Brokers Licensing Regulations, 2018, doesn't include continuous surveillance of clients. Once address verification is done, brokers aren't liable if clients relocate without notice. \r
The case stemmed from exporters flagged by the Directorate General of Analytics and Risk Management for fraudulent activities. The tribunal found no evidence of violation by the appellant broker and overturned the Commissioner's order revoking its license. \r
The ruling clarified that brokers are only responsible for advising clients on customs-related matters pertaining to their handled imports or exports, not broader legal compliance.
