The Supreme Court held that a Governor cannot indefinitely withhold a Bill without returning it to the State Assembly, as such conduct violates constitutional federalism and democratic norms. In the Presidential Reference, the Court clarified that the Governor must act with constitutional fidelity and facilitate the democratic law-making process. Non-action or obstructionist conduct disrupts the balance between elected governments and constitutional heads. The Court highlighted that withholding Bills without communication is unconstitutional and undermines separation of powers.
