South Mumbai District Commission Holds Bajaj Allianz General Insurance Co. Liable For Wrongful Repudiation Of Genuine Claim
The South Mumbai District Consumer Commission found Bajaj Allianz General Insurance liable for wrongful repudiation of a theft claim. The complainant, who had insured his car, faced claim denial despite promptly reporting the theft and filing a criminal complaint. The insurance company argued negligence due to the driver's brief absence with the engine running, but the Commission ruled this reasonable and criticized the insurer's defense. Consequently, Bajaj Allianz was directed to pay Rs. 5,95,380 with interest and Rs. 50,000 compensation for mental anguish and litigation costs.
