Supreme Court Expresses Dismay At HC Suspending Murder Sentence On Condition To Plant Tree Saplings
The Supreme Court sharply criticised a High Court’s order which suspended a conviction and sentence in a murder case on the unusual conditionality that the convict plant tree saplings. The apex court recorded its disquiet that measures of restorative or community service—while valuable in appropriate contexts—cannot be made a substitute for the rule of law where the seriousness of an offence like murder and the principles of sentencing law require proportionate penal consequences and statutory adherence. The Court analysed the legal boundaries of judicial discretion in suspension and commutation of sentences and emphasised that conditions attached to judicial mercy or suspension must have a sound legal basis, maintain parity with established sentencing principles, and respect victims’ rights and public interest in retribution and deterrence. The observation serves as a caution against creative but legally unsound conditions that risk undermining criminal jurisprudence.
