The Delhi High Court has overturned the suspension of a customs broker's license, deeming the order invalid under the Customs Broker Licensing Regulations (CBLR) 2018. The court found that the allegations against the broker did not justify the suspension, especially since the importers involved had retracted their statements. The court also highlighted that there was proper verification of the Importer-Exporter Code (IEC) and GSTIN. The suspension, initially based on the claim that the broker facilitated imports using incorrect IEC numbers, was ruled unjustified by both the High Court and the Customs, Excise, and Service Tax Appellate Tribunal (CESTAT), which had earlier set aside the penalty imposed on the broker.
