UP RERA sets format for possession letters
To prevent disputes between promoters and flat buyers arising from possession letters, UP RERA has provided a model format for such letters on its website. Promoters must issue possession offers only in this prescribed format, eliminating confusion and binding conditions. \r
The letters will be sent after receiving occupancy certificates to registered email and residential addresses, with SMS notifications. The promoter must also display information at project sites and their headquarters. The letter's core purpose should be to invite possession, specifying any remaining construction work and its completion timeline. \r
Any additional liabilities should align with the Sale Agreement. Letters not following the prescribed format will not be recognized. Possession offers must be sent within two months of receiving occupancy certificates, accompanied by the certificate issued by the development authority.
