In a recent development, the Kerala High Court has directed the Central government to consider appointing advocate Rajesh M Menon as the Special Public Prosecutor in the Walayar rape and death case, involving two minor girls.
The Court emphasized that while the appointment of a Public Prosecutor lies within the government's absolute discretion, the victim or their representative can request a lawyer of their choice, provided the lawyer is competent. The case, marked by a history of acquittals and subsequent retrial orders, prompted the victims' mother to seek Menon's appointment for effective prosecution.
The Court noted her legitimate concerns given past judicial outcomes and ordered a decision within three months, underscoring the importance of ensuring justice in the sensitive case.
