WAPs with MIMO but Without LTE Standards Eligible for Customs Duty Exemption: CESTAT Overrules Dept's Interpretation
The Customs, Excise, and Service Tax Appellate Tribunal (CESTAT) has ruled that Wireless Access Points (WAPs) that are equipped with MIMO (Multiple-Input Multiple-Output) technology but do not support LTE (Long-Term Evolution) standards are eligible for a customs duty exemption. The tribunal overruled the customs department's interpretation, which sought to deny the exemption. The department had argued that the presence of MIMO technology automatically implied that the devices were capable of supporting LTE, thereby disqualifying them from the exemption. However, the CESTAT, after examining the technical specifications, held that MIMO and LTE are distinct technologies. It concluded that since the imported WAPs did not have the LTE functionality, they met the conditions of the exemption notification. This decision highlights the importance of a correct technical understanding in classification and exemption matters, preventing the department from making interpretations based on incorrect assumptions.
