Service overview

A negotiation and mediation service that helps consumers and businesses resolve consumer disputes by agreement — before a case is filed, or while one is already pending before a Consumer Commission.

WCP professionals turn the grievance into a realistic settlement position and make sure the agreed resolution is properly documented and, where a case is pending, properly recorded.

Who needs it? / When is it needed?

Consumers or businesses willing to resolve a consumer dispute through negotiation or consumer mediation rather than a contested hearing.

Useful before evidence is lost or a limitation period becomes an issue; settlement can be explored first while the formal remedy stays available.

What to expect from the WCP Professionals

  • Review of the purchase or service record, complaint history and evidence of loss
  • A realistic settlement range and negotiating position
  • Communication of the demand and assessment of counter-offers
  • Representation in the Consumer Commission's mediation cell, where referred
  • Settlement terms recording amounts, actions and dates
  • Where a case is pending, the filing needed to record the settlement or withdraw the complaint

Key deliverables

  • Settlement proposal
  • Negotiation correspondence
  • Settlement agreement or consent terms
  • Mediation representation, where referred
  • Withdrawal or compliance documents

The settlement package states exactly what each side must do and by when.

Standard turnaround time

Negotiation can begin within 2–5 working days of receiving the documents.

Overall resolution depends on the other side's response. Mediation through a Consumer Commission is ordinarily concluded within 3 months of the parties' first appearance before the mediator, unless the Commission extends it.

Government fees, timelines & key outcomes

No government fee for private negotiation.

Mediation is available only on referral by the Consumer Commission with both parties' consent; any applicable charges are confirmed with the Commission at that stage. If a complaint is already pending, its filing fee will already have been paid.

Key outcomes: a documented settlement — refund, replacement, repair, compensation or other agreed relief — and, in mediation, an order recording it from which no appeal lies.

Forms & filings involved

  • Settlement agreement or consent terms
  • Mediation settlement report, where the matter is mediated
  • Withdrawal or compromise application, where a complaint is pending

The filing route is confirmed for the Commission and procedural stage concerned.

Documents required

  • Invoice or bill
  • Agreement or terms of service
  • Warranty or guarantee card
  • Complaint history and ticket numbers
  • Correspondence with the opposite party
  • Proof of payment
  • Any legal notice, complaint or order already on record

What we need from you

  • Your preferred settlement outcome
  • Your authority to negotiate within an agreed range
  • Quick responses when an offer arrives

Please identify the outcome you actually want — repair, replacement, refund or compensation — based on the loss and evidence rather than an arbitrary demand.

Important conditions

A settlement must state clearly whether it settles the dispute in full and whether any claim or proceeding remains pending.

Mediation needs both parties' consent; matters such as medical negligence causing grievous injury or death, and allegations of fraud or criminal offences, are excluded from consumer mediation.

Consumer status, limitation, pecuniary jurisdiction and the nature of the transaction are checked before any filing.

Additional information

Consumer mediation is a formal mechanism under Chapter V of the Consumer Protection Act, 2019, conducted by mediation cells attached to the Commissions.

A well-organised record of the complaint and the seller's response is useful whether the matter settles or proceeds to a hearing.

The estimated cost covers indicative professional fees only. Government fees, stamp duty and taxes are payable at actuals.

How it works

  1. 1. Raise a service enquiry describing your requirement.
  2. 2. A Relationship Manager reviews it and opens it for bidding.
  3. 3. Pay into escrow and assign the professional you select.
  4. 4. Track progress to completion, then accept and release payment.

Frequently asked questions

Can a consumer case be settled through mediation?

Yes. Under the Consumer Protection Act, 2019, the Commission can refer a dispute to its mediation cell at any stage if both parties consent in writing.

How long does consumer mediation take?

Mediation is ordinarily concluded within three months of the parties' first appearance before the mediator, unless the Commission extends the period.

Is a mediated settlement binding?

Yes. The Commission passes an order recording the settlement, and no appeal lies against an order passed on a mediated settlement.

Which consumer disputes cannot go to mediation?

Matters involving medical negligence resulting in death or grievous injury, serious allegations of fraud, forgery or coercion, and cases involving criminal offences are excluded.

What happens if negotiation or mediation fails?

The dispute returns to the Consumer Commission for adjudication, or a complaint can be filed if none is pending. The settlement attempt does not waive your right to pursue the complaint.
