Legal Notice for Protection
Estimate Cost
₹1,500 – ₹7,500
Typical duration
5 days

Service overview

A formal pre-litigation notice that states your grievance clearly and demands corrective action from a seller, manufacturer, e-commerce platform or service provider.

It often resolves the matter without a case, and if it does not, it creates the written record and evidentiary basis for a later consumer complaint.

Who needs it? / When is it needed?

Consumers facing a refused refund, a defective product, a deficient service, a warranty that is not honoured, or an unfair or misleading trade practice.

Best sent early — before evidence is lost, a warranty lapses or the two-year limitation period for a consumer complaint becomes a concern.

What to expect from the WCP Professionals

  • Review of the invoice, order, warranty and complaint history
  • Separation of provable facts from assumptions
  • Identification of the remedy you can properly demand
  • Drafting of a notice stating the facts, the legal and contractual basis and the relief sought
  • A clear response deadline, usually 15 days
  • Dispatch by Registered Post AD or Speed Post, with email where available, and retention of proof of service

Key deliverables

  • Drafted legal notice on the advocate's letterhead
  • Supporting annexures
  • Proof of dispatch and delivery
  • Advice on next steps if there is no reply

Standard turnaround time

2–5 working days to draft and dispatch a standard notice, once the bill, agreement and complaint history are available.

The response period given to the other side is usually 15 days, extended to 30 days where the facts call for it.

Government fees, timelines & key outcomes

No government fee is payable for issuing a private legal notice. Postage or courier charges are paid at actuals.

If the matter later proceeds to a Consumer Commission, the Commission's filing fee applies: nil for claims up to ₹5 lakh, and slab-based above that.

Key outcomes: a refund, replacement, repair, compensation or other corrective action — or a documented record that supports a consumer complaint.

Forms & filings involved

No prescribed government form.

The notice itself and the postal receipt and delivery acknowledgement (or tracking record) are retained as proof of service.

A legal notice does not replace a consumer complaint where formal relief from the Commission is needed.

Documents required

  • Invoice or bill
  • Order confirmation or agreement
  • Warranty or guarantee card
  • Complaint records and ticket numbers
  • Photographs or videos of the defect
  • Emails, chats and other correspondence
  • Proof of payment

What we need from you

  • The exact chronology of events
  • The transaction value
  • The remedy you want — repair, replacement, refund or compensation
  • The correct name and address of the opposite party

The demand should reflect your actual loss and evidence rather than an arbitrary figure.

Important conditions

A notice must not threaten remedies that have no legal basis or promise a particular outcome.

A response deadline does not oblige the other party to comply; the next step is negotiation or a consumer complaint.

Consumer status, limitation and the nature of the transaction are checked before any later filing.

Additional information

A properly drafted notice serves two purposes: it is the strongest opening for a settlement, and it becomes the first exhibit in a consumer complaint if the matter does not settle.

Estimated cost covers professional fees for drafting and dispatch; postage and courier charges are extra.

The estimated cost covers indicative professional fees only. Government fees, stamp duty and taxes are payable at actuals.

How it works

  1. 1. Raise a service enquiry describing your requirement.
  2. 2. A Relationship Manager reviews it and opens it for bidding.
  3. 3. Pay into escrow and assign the professional you select.
  4. 4. Track progress to completion, then accept and release payment.

Frequently asked questions

Is a legal notice mandatory before filing a consumer complaint?

No. The Consumer Protection Act, 2019 does not require one, but a notice frequently resolves the dispute and gives the Commission a clear record of your demand and the seller's response.

How long does the other party get to reply to a legal notice?

The notice usually gives 15 days, sometimes up to 30 days depending on the matter. The period is set by the notice itself, not by law, and missing it does not by itself decide the dispute.

How is a consumer legal notice sent?

Typically by Registered Post with Acknowledgement Due or Speed Post, often with a copy by email. The postal receipt and delivery record are kept as proof of service.

What if the company ignores the legal notice?

You can file a consumer complaint before the appropriate Consumer Commission. The unanswered notice supports your case by showing you gave the opposite party a fair chance to resolve it.

Can I send a legal notice to an online marketplace?

Yes. Notices can be sent to the seller, the manufacturer and, where relevant, the e-commerce entity, which must also maintain a grievance officer under the Consumer Protection (E-Commerce) Rules, 2020.
