Service overview

  • Termination of employment must strictly follow contractual terms, internal HR policies, and statutory labor laws
  • A flawed exit process can result in costly wrongful termination claims, reinstatement orders, and reputation loss for employers, or financial devastation for employees
  • The Wrongful Termination legal service provides sharp advocacy to evaluate termination grounds, challenge illegal dismissals, or construct defensible exit frameworks for organizations

Who needs it? / When is it needed?

  • Terminated Employees & Executives: Fired without notice, without cause, in breach of employment contract terms, or in retaliation (whistleblowing).
  • Corporate Employers & Management: Planning high-risk terminations, redundancies, or disciplinary dismissals requiring legal defense against future litigation.
  • HR Teams: Needing to conduct legally sound inquiry proceedings before terminating an employee for misconduct or underperformance.

What to expect from the WCP Professionals

  • Termination legality review: appointment letter, termination notice, severance computation, performance record and HR policies checked against the Industrial Relations Code, the contract and the State Shops & Establishments law
  • Procedure audit: whether a fair domestic inquiry was held, natural justice followed, and whether the termination was retaliatory — for example after a POSH or whistleblower complaint
  • Retrenchment check: one month's notice or pay, compensation of 15 days' average pay for each completed year of service, the re-skilling fund contribution, and prior government permission for establishments with 300 or more workers
  • Legal notice and negotiation of reinstatement or severance
  • Representation in conciliation, before the Industrial Tribunal or in civil proceedings

Important conditions

Workers covered by the Industrial Relations Code can seek reinstatement; employees outside it — such as managerial staff — usually get damages under the contract rather than reinstatement.

Time limits apply to raising a dispute, and contemporaneous documents — emails, appraisals and the termination letter — largely decide the outcome.

Additional information

From 21 November 2025, retrenchment, lay-off and closure are governed by the Industrial Relations Code, which also requires employers to contribute 15 days' wages per retrenched worker to a re-skilling fund.

Fixed-term employees under the Codes are entitled to benefits on a par with permanent staff, including gratuity after one year.

The estimated cost covers indicative professional fees only. Government fees, stamp duty and taxes are payable at actuals.

How it works

  1. 1. Raise a service enquiry describing your requirement.
  2. 2. A Relationship Manager reviews it and opens it for bidding.
  3. 3. Pay into escrow and assign the professional you select.
  4. 4. Track progress to completion, then accept and release payment.
