India is poised for a significant overhaul of its criminal justice system with the introduction of three new legal codes effective from July 1, 2024: the Bharatiya Nyaya Sanhita, 2023, Bharatiya Nagarik Suraksha Sanhita, 2023, and Bharatiya Sakshya, 2023. These codes will replace the Indian Penal Code (IPC), Criminal Procedure Code (CrPC), and Indian Evidence Act, respectively, marking a departure from colonial-era laws. The reforms respond to various factors, including the need to modernize legal frameworks in line with post-colonial identity and contemporary values, accommodate digital evidence and emerging crimes, and address systemic issues like case backlogs and low conviction rates. \r
The Bharatiya Nyaya Sanhita, 2023, consolidates and updates the IPC, introducing new offenses like hate speech and terrorism, and redefines sedition. The Bharatiya Nagarik Suraksha Sanhita, 2023, incorporates technological advancements in trials and procedures, while the Bharatiya Sakshya, 2023, addresses the admissibility of electronic records in evidence.
