Key Facts and Tribunal Findings
The Income Tax Appellate Tribunal (ITAT), Mumbai Bench, allowed the appeal of K.A. Investments Consultancy LLP for Assessment Year 2013–14 and quashed reassessment proceedings initiated under Sections 147/148, holding them to be invalid in law. The assessee, engaged in share trading and investment activities, had originally undergone scrutiny assessment under Section 143(3), wherein detailed examination of share transactions, including loss of approximately ₹22.89 crore in the scrip of Shree Nath Commercial and Finance Ltd., was undertaken. The Assessing Officer had issued multiple notices and examined extensive documentation including demat statements, broker ledgers, contract notes, bank statements, and survey statements recorded during proceedings.
Subsequently, the assessment was reopened based on the same loss transaction, coupled with an Investigation Wing report on alleged penny stock manipulation and findings from a survey conducted during the original assessment proceedings. The Tribunal noted that all materials relied upon for reopening—including the investigation report, survey findings, statement of the partner, and transaction details—were already available on record and had been specifically examined during the original assessment.
It held that the reopening was not based on any new tangible material but merely on reappraisal of existing facts. The Tribunal rejected the Revenue’s contention that fresh information emerged subsequently, observing that even the investigation inputs and survey material formed part of the original assessment record. Applying the settled principle that reassessment cannot be used as a tool for review, the Tribunal held the reopening to be a clear case of “change of opinion.”
Accordingly, the notice issued under Section 148 and the consequent reassessment order were quashed. All additions, including disallowance of business loss, Section 14A disallowance, and alleged commission income, were rendered academic and not adjudicated.
